Acme Security, Inc.- QUARTERLY REVIEW OF LAWSUITS
Each employee of Acme. must be aware of mistakes that
could be costly and emotionally damaging for both the individual and the
company. Actions of this nature will be reviewed by management personnel on a
quarterly basis and is part of the company’s Policy & Procedures Manual, Section
1 “Employment Practices”.
The following is a review of the high exposure areas and situations that can
easily result in a lawsuit:
1. False Arrests – Although both misdemeanor and felony arrests can lead to
false arrest accusations, we find ourselves more involved with misdemeanor type
situations. Shoplifting, trespassing and vandalism usually fall under
misdemeanor offenses. You must observe the misdemeanor crime take place in order
to take action. A misdemeanor must be committed in your presence, seen by your
eyes. Never allow anyone to tell you to arrest or detain any person unless you
actually observe the crime. You are subject to becoming involved in a MAJOR
LAWSUIT by detaining these types of suspects for misdemeanor crimes and not
seeing the crime occur!! DO NOT GUESS. Furthermore, we are not contracted with
any client to apprehend misdemeanor suspects. We are deployed as prevention. We
have reviewed the difference with apprehension and prevention with each client.
2. Verbal Confrontations – Individuals are losing their lives daily in our
cities due to verbal confrontations. Negative comments to others can lead to
serious accusations that could lead to a possible lawsuit. WE MUST AVOID VERBAL
CONFRONTATIONS AT ALL COSTS!!!
3. Excessive Force - All employees are always to keep a proper distance from
individuals. You are never to touch another individual, either an employee,
client or member of the general public. If polite verbal instructions fail to
address the issue regarding a potential problem, it is the responsibility of the
employee to: 1) request supervision and 2) consider law enforcement involvement.
4. Failure to Provide Security - Remain alert and do the job you were hired to
accomplish. When you are not doing your assigned tasks; you can become involved
in a lawsuit and risk the chance of our company losing an account. In the event
of a crime, fire, or other disaster while you are on duty and you are
inattentive, sleeping or distracted, you will be liable for the results. The
following are questions you should be able to answer at all times:
· Who and What is coming in?
· Who or What is going out?
· What is going on?
You can be assured that if you are not able to answer all three questions at all
times, you are liable for the common lawsuit that is entitled “Failure to
Provide Security.”
5. Harassment – The Company will not tolerate any form of sexual, racial,
physical, or verbal harassment in the work environment. Harassment is any
unwelcome conduct of a sexual, racial, physical, or verbal nature, especially
when that conduct is made as a term of employment or the basis of employment
decisions, or when the form of harassment has the purpose or effect of
unreasonably interfering with an individual’s work performance or creating an
intimidating or hostile work environment. You must know if this occurs, you have
created a liability for yourself and the company. Please refer to our Policy &
Procedures Manual: Sexual Harassment, Racial Harassment, or Harassment for
defined lines you must adhere to at all times.
6. Use Of Client’s Computers - While on duty and assigned to an account you are
to never use a client’s computer for any reason. When you use a client’s
computer you are neglecting your assigned duties and you are failing to provide
security. It is our expectation that you will never use a client’s computer. The
use of a client’s computer while on duty and assigned to an account will be
considered as employee misconduct. This misconduct may fall within the
categories of dishonesty, theft, gross misconduct and failure to respect the
property of a client. Disciplinary action, including termination, could result
from violations associated with this NPS Policy.
7. Acme. provides unarmed security officers to the
majority of our clients. Acme. requires that no
firearms are to be carried by security officers deployed at accounts provided
with unarmed security service. Please be advised that our expectations are that
no firearms will ever be on any property that we deploy unarmed security
officers to, either being carried by our security officers or in their vehicles.
8. Review this policy periodically to ensure you are following and understand
each area. Contact your immediate supervisor or the Human Resources Department
if you have any questions. Please refer to our Company Handbook: Complaint
Review Procedures for channels of communication.
9. Each quarter during our discussion, present any questions for open forum.
